1. Acceptance of Terms

By accessing or using the WUBBA platform (app.wubba.ai) and related services operated by Eyentelligence Inc. ("Eyentelligence," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

WUBBA is a white-label AI-powered business automation platform that provides:

  • AI agent services across multiple channels (chat, SMS, email, voice, fax, social media)
  • AI-generated marketing content including text, images, and videos
  • Social media scheduling and publishing
  • Customer relationship management tools
  • Business workflow automation
  • Website generation and hosting

3. Account Registration

To use our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use our platform to:

  • Violate any applicable laws, regulations, or third-party rights
  • Send spam, unsolicited messages, or harassing communications
  • Generate or distribute harmful, misleading, or illegal content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the platform or its infrastructure
  • Use AI-generated content to impersonate individuals or deceive others
  • Violate platform-specific terms of connected social media services
  • Transmit content that infringes intellectual property rights

5. AI-Generated Content

Our platform uses artificial intelligence to generate content. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or appropriate
  • You are responsible for reviewing and approving all AI-generated content before publication
  • You retain ownership of content you create using our tools, subject to third-party AI provider terms
  • We are not liable for any consequences arising from the use or publication of AI-generated content

6. Social Media Integration

When you connect social media accounts to our platform, you authorize us to post content on your behalf to those platforms. You are responsible for ensuring that content published through our platform complies with each platform's terms of service and community guidelines. We are not responsible for actions taken by social media platforms regarding your accounts or content.

7. Communications (SMS, Email, Voice, Fax)

You are solely responsible for obtaining proper consent before sending communications through our platform. You must comply with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any other relevant regulations. You agree to maintain proper opt-out mechanisms and honor unsubscribe requests promptly.

8. Payment and Billing

Paid features are billed according to the pricing plan you select. Payments are processed securely through Stripe. You agree to provide accurate billing information and authorize recurring charges as applicable. Refunds are handled on a case-by-case basis. We reserve the right to modify pricing with 30 days' notice.

9. Intellectual Property

The WUBBA platform, including its design, code, features, and branding, is the property of Eyentelligence Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform without our written consent.

Content you create and upload remains your property. By using our platform, you grant us a limited license to process, store, and transmit your content as necessary to provide our services.

10. Limitation of Liability

To the maximum extent permitted by law, Eyentelligence Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use our platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

Our platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

12. Termination

We may suspend or terminate your access to our platform at any time for violation of these terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases, and we may delete your data after a reasonable retention period.

13. Governing Law

These terms are governed by the laws of the State of Kansas, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Shawnee County, Kansas.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through the platform or via email. Your continued use of the platform after changes constitutes acceptance of the updated terms.
